Is the killing of a person by judicial process as a punishment for an offense.
Gideon v. Wainwright
The court held that if a person is accused of a felony and cannot afford an attorney, an attorney must be made available to the accused person at the govts expense
Death row appeals
The law limits access to the federal courts for all defendants convicted in state courts.  it also imposes a severe time limit on death row appeals.  on avg, it takes seven years to exonerate someone on death row.
Cruel and unusual punishment
The eighth amendment prohibits cruel and unusual punishment.  the court ruled that capital punishment is not necessarily cruel and unusual if the criminal has killed or attempted to kill someone.
